This website, maritimeseascapes.com, is owned and operated by Willabeth Capital Corporation, carrying on business as Maritime Seascapes ("Maritime Seascapes," "we," "us," or "our"), located at 1727 - 400 Gower Point Rd, Gibsons British Columbia V0N 1V0.
By visiting the site, subscribing to our newsletter, opting in to text messages, or placing an order, you agree to these Terms of Service and to our Privacy Policy https://maritimeseascapes.com/privacy-policy Refund and Shipping Policy (https://maritimeseascapes.com/refund-policy), and SMS Terms https://maritimeseascapes.com/sms-terms , all of which are incorporated here by reference.

2. Eligibility
You must be at least the age of majority in your province, state, or country to purchase from this site, or have the consent of a parent or guardian. By placing an order you confirm that you meet this requirement and that the information you provide is accurate and complete.
3. The Artwork We Sell
Maritime Seascapes offers:
Original paintings by Elizabeth A. Evans, each a unique work
Fine art prints on canvas, produced to order by our print partner
Fine art posters
Art cards, sold singly and in packs
Other items we may add from time to time
Elizabeth paints from memory rather than from photographs. Titles and descriptions refer to scenes inspired by East Coast fishing villages. They are compositions drawn from memory and imagination and do not depict a specific named location unless expressly stated.
3.1 Editions
Where a work is offered as a limited edition, the product page states the edition size and the medium to which the edition applies. Once an edition is sold out, that image will not be reissued in that size and medium. Where a work is offered as an open edition, the product page will say so.
3.2 Certificates
Limited edition canvas prints and original paintings are supplied with a signed certificate of authenticity identifying the title, size, medium, and, for limited editions, the edition number.
3.3 Colour and appearance
We take care to represent each work accurately. Screens, browsers, and device settings vary, and printed pigment behaves differently from backlit colour. Slight variation between what you see on screen and the work you receive is normal and is not a defect.
Prints are made to order. Canvas prints are supplied gallery wrapped on museum grade stretchers with finished edges and are ready to hang without a frame unless the product page states otherwise.
4. Orders, Prices, and Payment
4.1 Placing an order
Adding an item to your cart is an invitation to treat, not an offer. Your order is an offer to buy. A contract is formed only when we send you an order confirmation or dispatch the goods. We may decline or cancel an order, in whole or in part, for reasons including product unavailability, an error in price or description, suspected fraud, or an inability to verify billing or shipping details. If we cancel an order you have paid for, we refund you in full.
4.2 Prices and currency
All prices are shown in USD unless otherwise stated at checkout. Prices may change at any time without notice. The price that applies to your order is the price shown at the time you complete checkout.
4.3 Errors
Despite our care, the site may occasionally contain an error in price, description, availability, or image. We reserve the right to correct errors and to cancel any order placed on incorrect information, even after an order confirmation has been sent. If we cancel for this reason, we refund you in full.
4.4 Payment
Payments are processed by Stripe and by PayPal. By submitting payment information you authorize us and our processors to charge the total order amount, including shipping and applicable taxes, to your chosen payment method. We do not collect or store full payment card numbers.
Your use of Stripe and PayPal is also governed by their own terms and privacy policies. If a payment is declined, reversed, or charged back, we may cancel the order and suspend future orders.
4.5 Taxes and duties
Applicable Canadian taxes (GST, and PST or HST where required) are calculated and added at checkout for Canadian orders. Where we are required to collect United States sales tax, it is calculated and added at checkout.
For orders shipped outside Canada and the United States, any customs duties, import taxes, and brokerage fees are the responsibility of the recipient and are not included in the price or shipping charge.
5. Shipping and Delivery
Shipping, production times, delivery estimates, and title and risk of loss are set out in our Refund and Shipping Policy (https://maritimeseascapes.com/refund-policy), which forms part of these terms.
We currently offer free standard shipping within Canada and the United States on the products marked as eligible. Delivery estimates are estimates only and are not guaranteed dates.
6. Returns and Refunds
Our return window, conditions, exclusions, and the process for requesting a return are set out in the Refund and Shipping Policy (https://maritimeseascapes.com/refund-policy).
In short: made to order prints, cards, and posters may be returned within the stated window if you notify us first and return them in original condition and packaging. Original paintings and custom or oversized work are treated differently. Damaged or defective items are always made right. Please read the full policy before ordering.
Nothing in these terms limits any non-waivable consumer rights you have under the law of your province, state, or country.
7. Text Messages and Email
7.1 Text messages
If you provide your mobile number and check the SMS consent box, you consent to receive text messages from Maritime Seascapes at that number, including messages sent using an automatic telephone dialing system.
Consent to receive marketing text messages is not a condition of any purchase.
Message frequency varies. Marketing messages are typically no more than 4 per month.
Message and data rates may apply. Your carrier's standard rates apply to messages you send and receive.

Carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier's network and your device, and is not guaranteed.

You must be the account holder or have the account holder's permission to opt in the number you provide, and you agree to tell us if the number is reassigned or no longer yours.

7.2 Email
By subscribing, requesting the free bookmark, or purchasing, you agree to receive transactional emails about your order and, where you have consented, marketing emails. Every marketing email includes an unsubscribe link.
8. Intellectual Property
All paintings, images, photographs, text, product descriptions, video, logos, and the design of this website are the property of Elizabeth A. Evans and Maritime Seascapes, or are used with permission, and are protected by Canadian and international copyright and trademark law.
Maritime Seascapes," the Maritime Seascapes logo, and "Brickilism" are marks used by us in connection with our goods and services.
Purchasing a painting, print, poster, or card transfers ownership of that physical object only. Copyright is retained by the artist. You may not reproduce, scan, photograph for commercial use, print, publish, license, or create derivative works from the artwork without our prior written permission. You may photograph your purchased work in your home and share it socially for personal, non-commercial purposes.
You may not copy, scrape, republish, or use any content from this site for commercial purposes, or use it to train machine learning or artificial intelligence models, without our prior written permission.
9. Acceptable Use
You agree not to:
Use the site for any unlawful purpose or in breach of these terms
Attempt to gain unauthorized access to the site, accounts, or systems
Introduce viruses, malicious code, or automated scraping tools
Interfere with the operation, security, or availability of the site
Submit false, fraudulent, or misleading information, including fraudulent orders or chargebacks
Harass, abuse, or threaten our staff or other users
We may suspend or terminate access, and cancel orders, if we reasonably believe you have breached this section.
10. User Submissions
If you send us reviews, comments, photographs, or other content, you grant us a non-exclusive, royalty free, worldwide licence to use, reproduce, and display that content in connection with the Maritime Seascapes brand, including on the website, in email, and on social media. You confirm that you own the content or have the right to grant this licence. We are not obliged to publish or keep any submission and may remove content at our discretion.
11. Third Party Tools and Links
The site may use third party tools, including a wall visualization tool, chat features, analytics, and payment services, and may link to third party websites. Those tools and sites are provided "as is." We make no representations about them and are not responsible for their content, availability, or practices. Your use of them is at your own risk and subject to their terms.
12. Disclaimer of Warranties
The site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error free.
This section does not exclude any warranty or condition that cannot be excluded under applicable consumer protection law.
13. Limitation of Liability
To the fullest extent permitted by law, Maritime Seascapes, Elizabeth A. Evans, and anyone working with us will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, or goodwill, arising out of your use of the site or your purchase of any product.
Our total aggregate liability arising out of or relating to your use of the site or any order will not exceed the greater of the amount you paid for the product giving rise to the claim, or fifty Canadian dollars.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those places, our liability is limited to the greatest extent permitted by law.
14. Indemnity
You agree to indemnify and hold harmless Maritime Seascapes, Elizabeth A. Evans, and our contractors and service providers from any claim, loss, liability, or expense, including reasonable legal fees, arising out of your breach of these terms, your misuse of the site, or your infringement of the rights of any third party.
15. Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including postal and courier disruption, carrier delays, customs delays, supplier or print partner failure, labour disputes, power or network outages, severe weather, fire, flood, epidemic, or government action.
16. Governing Law and Disputes
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in that province, without regard to conflict of law principles. The courts of British Columbia have jurisdiction over any dispute, and you consent to that jurisdiction.
If you are a consumer resident elsewhere, this clause does not deprive you of the protection of mandatory consumer laws in your place of residence.

17. General
Entire agreement. These terms, together with the Privacy Policy, Refund and Shipping Policy, and SMS Terms, are the entire agreement between us regarding the site and your orders.
Severability. If any provision is found unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign your rights under these terms. We may assign ours in connection with a sale or reorganization of the business.
Changes. We may update these terms at any time by posting a revised version with a new effective date. The version in force when you place an order governs that order.
