This Privacy Policy explains what personal information we collect, why we collect it, how we use it, who we share it with, and the choices available to you. It applies to our website, our online store, our email newsletter, and our text message program.

2.1 Information you give us directly

Contact details. Your name, email address, mailing address, and phone number when you place an order, request the free bookmark, subscribe to the studio newsletter, or contact us.

Order information. The items you purchase, shipping and billing addresses, order notes, and gift messages.

Payment information. Card and payment details are entered directly into our payment processors (Stripe and PayPal). We do not see, collect, or store full payment card numbers on our systems.

Communications. Messages you send us by email, contact form, text message, or social media, including any information you choose to include in them.

Inquiries about original paintings. Information you provide when asking about the availability or price of an original work.

2.2 Information collected automatically


Device and usage data. IP address, browser type, operating system, referring page, pages viewed, time spent, and links clicked.

Cookies and similar technologies. Small files placed on your device that keep your shopping cart working, remember your preferences, and help us understand how the site is used. See Section 8.

Marketing and analytics pixels. We use tools that may include the Meta (Facebook and Instagram) pixel, Google Analytics, and similar technologies to measure the performance of our advertising and content.

2.3 Information from third parties

We may receive information from our payment processors, our shipping and print fulfillment partners, and our advertising platforms. For example, our fulfillment partners confirm when an order has shipped and provide tracking numbers.

We do not buy personal information from data brokers.


3. How We Use Your Information

We use personal information to:

Process, fulfill, and deliver your orders, including sending order confirmations, shipping notices, and tracking updates.

Provide customer service and respond to your questions, return requests, and inquiries about original paintings.

Send the free bookmark and the studio newsletter you requested, and send marketing emails and text messages where you have given consent.

Operate, maintain, secure, and improve the website and store.

Measure and improve our advertising, including showing relevant ads to people who have visited the site.

Detect and prevent fraud, abuse, and unauthorized transactions.

Meet our legal, tax, and accounting obligations.

Our legal bases for processing, where applicable, are the performance of a contract with you, your consent, our legitimate interests in running and improving a small art business, and compliance with law.


4. Text Message (SMS) Program and Your Mobile Information

This section applies to our text message program. Please read it carefully.

4.1 Consent

If you provide your mobile number and give consent, we may send you text messages relating to your orders and, where you have separately agreed, occasional marketing messages about new work, collections, and studio news.

Consent to receive marketing text messages is not a condition of any purchase. Consent is collected through a separate, unchecked checkbox. We do not add anyone to the text program without an affirmative opt-in.


4.2 How your mobile information is handled

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be shared with any third parties.

Information sharing with subcontractors who provide support services to us, such as our messaging platform, customer service tools, and order fulfillment providers, is permitted only so that we can operate the text message program and fulfill your orders. Those providers act on our instructions, are bound by confidentiality, and may not use your mobile information for their own marketing.

We do not sell mobile phone numbers. We do not rent, trade, or license mobile phone numbers or SMS consent records to anyone. We do not share mobile numbers or consent data for lead generation or third-party analytics purposes.

4.3 Program details

Program name: Maritime Seascapes

Message types: order and shipping notifications, replies to customer questions, and, with separate consent, occasional promotional messages.

Message frequency: varies. Marketing messages are typically no more than 4 per month.

Cost: Message and data rates may apply. We do not charge for the messages themselves.


4.4 Opting out and getting help

Reply STOP to any message to end the program at any time. You will receive one confirmation message and then no further messages, other than any message required to complete a transaction already in progress.

Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier and device.

4.5 Retention of consent records

We keep records of your opt-in and opt-out so that we can honour your choices and demonstrate compliance. These records are retained for as long as required by applicable law and industry rules, and are not shared with third-party marketers.

5. Email Marketing

If you subscribe to the studio newsletter, request the free bookmark, or purchase from us, we may send you emails about Elizabeth's work, new releases, and studio news. Every marketing email includes an unsubscribe link. You may also unsubscribe by emailing [email protected].

Transactional emails, such as order confirmations and shipping notices, are not marketing and are sent for every order.

We comply with Canada's Anti-Spam Legislation (CASL) and the United States CAN-SPAM Act.

6. When We Share Information

We share personal information only as described below. We do not sell your personal information.

Payment processors (Stripe, PayPal) — To authorize and process payments and handle chargebacks

Print and fulfillment partners (for example Pictorem for fine art prints, and our print partner for cards and posters) — To produce and ship your order

Shipping carriers — To deliver your order and provide tracking

Website, CRM, email, and SMS platform providers — To operate the store, send communications, and provide customer service

Analytics and advertising platforms — To measure site performance and advertising, subject to Section 4.2 for mobile data

Professional advisers, accountants, and legal counsel — To operate the business and comply with law

Government or law enforcement — Where required by law, court order, or to protect our rights and the safety of others

A successor entity — If the business or its assets are sold or reorganized, subject to this policy

Mobile phone numbers and SMS consent data are excluded from any sharing for marketing or promotional purposes, as set out in Section 4.2.

7. Where Your Information Is Held

We are located in British Columbia, Canada. Our service providers may store and process information in Canada, the United States, and other countries. Where information is transferred outside your country of residence, we take reasonable steps to ensure it is protected by appropriate safeguards and contractual commitments.

Information held in another country may be accessible to the courts, law enforcement, and national security authorities of that country under its laws.

8. Cookies and Tracking

We use cookies and similar technologies for:

Strictly necessary purposes, such as keeping items in your cart and securing checkout. These cannot be turned off.

Analytics, to understand how visitors use the site.

Advertising, to measure ad performance and show relevant ads on platforms such as Facebook and Instagram.

You can control cookies through your browser settings. Blocking cookies may affect how the store works. Where required by law, we present a cookie banner allowing you to accept or decline non-essential cookies.

We honour Global Privacy Control (GPC) signals where applicable law requires it.

9. How Long We Keep Information

We keep order and transaction records for as long as required by Canadian tax and business law, generally seven years. Newsletter and SMS subscriber records are kept until you unsubscribe, plus a reasonable period to record your opt-out. Website analytics data is kept in line with the retention settings of the relevant platform.

10. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted connections (HTTPS), access controls, and reputable service providers. Payments are handled by PCI DSS compliant processors.

No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you provide information to us at your own risk.

11.2 Canada

We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. 11.3 United States

Residents of California and other states with comprehensive privacy laws may have rights to know, delete, correct, and opt out of the sale or sharing of personal information and of targeted advertising. We do not sell personal information and we do not share mobile information or SMS consent for marketing. To exercise a right, contact us using the details in Section 1. We will not discriminate against you for exercising your rights.

11.4 United Kingdom and European Economic Area

If you are located in the UK or EEA, you may have rights of access, rectification, erasure, restriction, objection, and data portability, and the right to lodge a complaint with your supervisory authority.

The website and store are intended for adults. We do not knowingly collect personal information from anyone under the age of majority in their province, state, or country. If you believe a minor has provided us with personal information, contact us and we will delete it.
